General Terms and Conditions of Use of the Website

These general conditions of use (hereinafter "GCU") of the website .... (hereinafter "the Site") govern all relations between :

- On the one hand, the company ARKIPEL with a share capital of 15000 euros, registered with the RCS of Paris

under n°949 507 065 whose registered office is located at 3 rue des Perchamps, 75016 Paris, France (hereinafter "ARKIPEL")

 - And on the other hand, any individual or legal entity accessing the Site (hereinafter "the User"), for the purposes of:

• Browsing on the Site and consulting its various contents

All of the aforementioned parties are subject to the stipulations of these GCU.

I.          PURPOSE OF THESE GCU

The purpose of these GCU is to define the conditions of use of the Site published by ARKIPEL and therefore the entire relationship between ARKIPEL and Users.

By browsing the Site, Users expressly and unequivocally accept these GCU.

ARKIPEL reserves the right to modify these GCU at any time and without notice.

ARKIPEL's failure to invoke any provision of the GCU shall not be interpreted as a waiver of its right to invoke said provision at a later date.

II.         ACCESS AND USE OF THE SITE  

To access the Site and its contents, the User must confirm that he/she is of legal age. The User must also be over 18 years of age. The Site cannot be held responsible for any misleading information provided by the User in this respect.

The Site may be inaccessible in certain territories for legal reasons, in particular due to regulations governing alcohol advertising.

Thus, by browsing the site operated by the company LEXIR and ordering products from it, the User expressly acknowledges that he/she has an exclusive legal relationship with the company LEXIR. 

As such, the User will be bound by the company's own terms and conditions of sale...

It is therefore specified that ARKIPEL takes no part, at any time, in the legal and in particular contractual relations entered into between the company LEXIR and the User in the context of the ordering of such products.

ARKIPEL cannot therefore be held responsible for any damage that may result, directly or indirectly, from accessing or using the information and services offered by the company LEXIR, or from the execution of said services.

IV.        CONTRACTUAL LIMITATION ON TECHNICAL DATA 

ARKIPEL shall not be held liable for any material damage arising from the use of the Site.

The Site is hosted by a service provider in the territory of the European Union in accordance with the provisions of the General Data Protection Regulation (RGPD: n° 2016-679). In accordance with the RGPD, personal data is hosted within the EU.

The host ensures the continuity of its service 24 Hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible time, in particular for maintenance purposes, to improve its infrastructures, in the event of infrastructure failure or if the Services generate traffic deemed abnormal.

ARKIPEL and the host cannot be held responsible in the event of malfunction of the Internet network, telephone lines or computer and telephony equipment, in particular due to network congestion preventing access to the server.

V.         USER LIABILITY

When using the Site, the User undertakes to refrain from any unlawful behaviour that is contrary to legal standards, whether in terms of comments made or content disseminated.

Consequently, ARKIPEL may not be held liable for any damage that may result, directly or indirectly, from access to or use of the information contained on the Site by the User.

VI.        INTELLECTUAL PROPERTY

ARKIPEL is the owner of the intellectual property rights and holds the rights of use on all the elements accessible on the Site, in particular the texts, images, graphics, logos, videos, icons and sounds.

Any unauthorized use of these elements will be considered as constituting an act of counterfeiting prosecuted in accordance with the provisions of the French Intellectual Property Code.

VIII.     COMPETENT COURTS

The present terms and conditions and any contract entered into incorporating these terms and conditions are governed by French law and all disputes are subject to the exclusive jurisdiction of the courts of Paris.

However, in the event of any dispute relating to the interpretation of these terms and conditions or the performance of their respective obligations, the parties shall endeavor to reach an amicable agreement before taking any legal action, and shall provide each other with all necessary information to this end.
